The list

10. The list



(1) The Governor in Council may, on the recommendation of the Minister, and by
Order published in the Government Gazette specify, in a list, any taxon or
community of flora and fauna which is threatened, and may amend the list or
repeal the whole or any part of the list.

(2) The Governor in Council may, on the recommendation of the Minister, and by
Order published in the Government Gazette specify, in a list, any potentially
threatening process, and may amend the list or repeal the whole or any part of
the list.

(3) The Minister may make a recommendation under subsection (1) or (2) only
after considering a recommendation of the Committee.

(6) The Committee may recommend to the Minister that an eligible taxon or
community of flora or fauna or an eligible process be added to the Threatened
List or the Processes List or that any taxon or community of flora or fauna or
any process which is no longer eligible be repealed from the Threatened List
or the Processes List.

(7) The Minister in making a recommendation under this Part and the Committee
in making a recommendation under this Part and in preparing the list of
criteria for eligibility must have regard only to nature conservation matters.
