Addition of beneficiaries to be notified

24C. Addition of beneficiaries to be notified



(1) This section applies if a registered fundraiser decides to conduct a
fundraising appeal for the benefit of any person, thing, cause or class of
person not previously listed as a beneficiary by the registered fundraiser
under section 18(2)(g) or 22 when applying for registration, or the renewal of
registration, or under this section.

(2) At least 28 days before conducting any fundraising appeal on behalf of the
person, thing, cause or class, the registered fundraiser-

   (a)  must notify the Director in a form and manner approved by the Director
        of the additional person, thing, cause or class; and

   (b)  must give the Director-

   (i)  the written consent of the additional beneficiary to becoming an
        intended beneficiary of the appeal; or

   (ii) a written explanation of why it is not practicable to comply with
        subparagraph (i). Penalty: In the case of a corporation, 240 penalty
        units. In any other case, 120 penalty units or imprisonment for 12
        months or both.

(3) If the intended beneficiaries of an appeal are the members of an
organisation, the written consent of a duly authorised representative of the
organisation is sufficient compliance with subsection (2)(b)(i) with respect
to the members of the organisation.

(4) The Director may waive the 28 day requirement in subsection (2) in a
particular case if the Director is satisfied that it is reasonable to do so.
