Use and emptying of receptacles to be properly supervised

11. Use and emptying of receptacles to be properly supervised



(1) A person who is conducting a fundraising appeal must ensure that the use
and emptying of any receptacles that are used to collect money for the appeal
are supervised in a way that ensures, to the maximum extent that is
practicable in the circumstances of the appeal-

   (a)  in the case of a fundraising appeal to which Part 3 applies, that all
        the money is deposited in one of the accounts referred to in section
        27;

   (b)  in any other case, that all the money is collected and given to the
        person.

Penalty: In the case of a corporation, 120 penalty units.
In any other case, 60 penalty units or imprisonment for 6 months or both.

(2) A person who is conducting a fundraising appeal must ensure that the use
and emptying of any receptacles that are used to collect donations other than
money for the appeal are supervised in a way that ensures, to the maximum
extent that is practicable in the circumstances of the appeal, that all the
donations are collected and properly processed.

Penalty: In the case of a corporation, 120 penalty units.
In any other case, 60 penalty units or imprisonment for 6 months or both.
