Court may extend period

68. Court may extend period



(1) An inspector may apply to the Magistrates' Court within 3 months after
seizing a thing or, if an extension has been granted under this section,
within that extended period, for an extension of the period during which the
seized thing may be retained.

(2) The Magistrates' Court may order the extension of the period during which
a seized thing may be retained if satisfied that retention of the thing is
necessary-

   (a)  for the purposes of an investigation into whether an offence has been
        committed; or

   (b)  to enable evidence of an offence to be obtained for the purposes of a
        prosecution.

(3) The Magistrates' Court may adjourn an application to enable notice of the
application to be given to any person.
