Winding up

39. Winding up

If a funeral provider which is a body corporate is commenced to be wound up or
a receiver or receiver and manager is appointed for a funeral provider which
is a body corporate-

   (a)  any pre-paid funeral contract to which the funeral provider was a
        party is deemed to have been terminated immediately before that
        commencement or appointment; and

   (b)  any assignment or transfer to the funeral provider of any investment
        or any interest in an investment by any other party to the contract or
        any promise by any other party to the contract to assign or transfer
        an investment or any interest in an investment to the funeral provider
        is deemed to have been cancelled immediately before that commencement
        or appointment.
