Conflicts of interest-Chief Executive Officer and employees

42. Conflicts of interest-Chief Executive Officer and employees



(1) This section has effect where a person who is the Chief Executive Officer
of a body or is an employee of a body is performing functions or services as
Chief Executive Officer of the body or as employee of the body, as the case
may be, and is required to consider a matter in which the person has a direct
or indirect pecuniary or other interest that could involve a conflict with the
proper performance or exercise by the person of those functions or services.

(2) In the case of the Chief Executive Officer of the body, the person must
without delay give to the President of the body a written notice-

   (a)  stating that he or she is required to consider the matter and has an
        interest in it; and

   (b)  setting out particulars of the interest.

(3) In the case of an employee of the body, the person must without delay give
to the Chief Executive Officer of the body a written notice-

   (a)  stating that he or she is required to consider the matter and has an
        interest in it; and

   (b)  setting out particulars of the interest.

(4) The person must do whatever is necessary to avoid the conflict referred to
in subsection (1).
