FUNDRAISING ACT 1998 - SECT 40

Evidentiary provisions

    (1)     Despite anything to the contrary in the Magistrates' Court Act 1989 and the Rules made under that Act, evidence before the Court on the hearing of an application or a reference may be given in writing, or partly in writing, and may be given by a statutory declaration.

    (2)     However, the Court must not receive evidence from any person who is not available for cross-examination, unless each party to the hearing consents to it doing so.

    (3)     Any consent given under subsection (2) forms part of the record of the Court.
