Transfer of individual quota units

65A. Transfer of individual quota units



(1) A transfer of individual quota units may only be made with the approval of
the Secretary.

(2) The holder of an access licence in a quota fishery may apply to the
Secretary for approval to transfer a fraction of, or 1 or more, individual
quota units to the holder of any other access licence for that fishery.

(2A) If the Minister has made an order under section 64AB(1)(d), subsection
(2) is to be read as if for "for that fishery" there were substituted "for the
relevant sub-zone of that fishery".

(3) An application for the approval of a transfer must-

   (a)  be made in the manner and form required by the Secretary; and

   (b)  if applicable, be accompanied by the relevant quota notice or notices.

(4) The Secretary may grant an application if it is consistent with every
quota order and management plan that applies to the quota fishery.

(5) The Secretary must refuse to grant an application that is inconsistent
with any relevant provision of this Act.
