Exemptions concerning food safety programs

19V. Exemptions concerning food safety programs





(1) The Secretary may exempt a proprietor of a declared premises, or the
proprietors of a class of declared premises, from-

   (a)  the need to have a food safety program, or for a food safety program
        that fully complies with this Act; or

   (b)  the need to comply with any requirement in a food safety program; or

   (c)  the need to have a food safety program audited in accordance with this
        Act; or

   (ca) the need to have a food safety supervisor in relation to a premises;
        or



   (d)  the need to comply with any other requirement imposed on proprietors
        by this Part.

(2) In granting an exemption, the Secretary-

   (a)  must issue the exemption in writing; and

   (b)  must specify the period for which it is to apply; and

   (c)  may impose any condition that the Secretary considers to be
        appropriate.

(3) The Secretary may vary or revoke an exemption at any time by giving the
proprietor written notice of the variation or revocation.





(4) A failure to comply with a condition imposed under subsection (2)(c) is a
ground for-

   (a)  the refusal of the registration, renewal of registration or transfer
        of registration of the premises;

   (b)  the revocation or suspension of registration of the premises.
