Procedure if long-term tenant has not responded

    (1)     A notifying owner may commence fencing works and any subsidiary works for which a long-term tenant of the notifying owner's land is liable to contribute under this Act, without agreement from the long-term tenant, if the long-term tenant has not responded to the notice given by the notifying owner under section 15(1) within 30 days from the day the notifying owner gave the fencing notice to the adjoining owner.

    (2)     A notifying owner may commence fencing works and any subsidiary works for which a long-term tenant of the adjoining owner's land is liable to contribute under this Act, without agreement from the long-term tenant, if the long-term tenant has not responded to the notice given by the adjoining owner under section 15(2) within 30 days from the day the notifying owner gave the fencing notice to the adjoining owner.
