48. Provisions of Fences Act 1968 not to apply



(1) The provisions of the Fences Act 1968 shall not apply to or with respect
to any lands vested in the Board by this Act or used for the purposes of the
Emerald Tourist Railway and the Board shall not be liable under the
Fences Act 1968 to make any contribution towards the construction or repairing
of any dividing fence between the land of any occupier and any land vested in
the Board for the purposes of this Act.

(2) Despite any Act or rule of law to the contrary, the Board is not liable
for any damage which may be caused by reason of the Emerald Tourist Railway
not being fenced in or fenced off.
