General provisions relating to determinations

35. General provisions relating to determinations



(1) A determination must include a statement of the purpose and reasons for
the making of the determination.

(2) Notice of the making of a determination must be published-

   (a)  in the Government Gazette; and

   (b)  in a daily newspaper generally circulating in Victoria; and

   (c)  on the internet.

(3) The notice must include-

   (a)  a brief description of the nature and effect of the determination; and

   (b)  details of when the determination takes effect and how a copy of the
        determination may be obtained from the Commission.





(4) The Commission must send a copy of a determination-

   (a)  to each regulated entity in the regulated industry to which the
        determination applies; and

   (b)  to any person who made a submission to an inquiry to which the
        determination relates and who has asked for a copy of the
        determination.

(5) A determination takes effect on and from-

   (a)  the date on which notice of its making is published in the Government
        Gazette; or

   (b)  any later date of commencement as may be specified in the
        determination.

(6) Subject to anything to the contrary in the empowering instrument, a
determination has effect until-

   (a)  it is amended or revoked by a later determination; or

   (b)  such other date as is specified in the determination.

(7) A determination is binding on a regulated entity or a regulated industry
specified in the determination.
