Declaration of pecuniary interests
27. Declaration of pecuniary interests
(1) If a Commissioner has a pecuniary interest in a matter which he or she is
considering or is about to consider in the course of performing his or her
duties as a Commissioner, the Commissioner must as soon as practicable after
the relevant facts have come to the Commissioner's knowledge declare the
nature of that interest to the Minister.
(2) Subsection (1) does not apply if the interest is as a result of the supply
of goods or services that are available to members of the public on the same
terms and conditions.
(3) Unless the Minister otherwise directs, if a Commissioner has made a
declaration under this section, the Commissioner must not take any further
part in any decision in relation to the matter.
(4) A failure to comply with this section does not affect the validity of any
act or decision of the Commission or a Commissioner.
