Validation of application

99. Validation of application





(1) Energy Safe Victoria may require an applicant under section 98 to obtain
an independent validation of the application.



(2) Energy Safe Victoria may require the validation to assess-



   (a)  the financial viability of the applicant; and

   (b)  the capacity of the applicant to exercise the relevant functions of
        Energy Safe Victoria for which acceptance is sought; and



   (c)  any aspect of the proposed systems and procedures set out in the
        application.

(3) The applicant must establish to the satisfaction of Energy Safe Victoria
that each person undertaking the validation of the application has the
necessary competence and ability and access to information on the applicant
and the application to arrive at an independent opinion on the application.





(4) If Energy Safe Victoria requires an applicant to provide an independent
validation of the application, the costs of that validation must be borne by
the applicant.

(5) Energy Safe Victoria is not required to proceed with the consideration of
an application until the independent validation is provided.
