Application

5. Application

This Act does not apply to-

   (a)  a workplace within the meaning of the
        Occupational Health and Safety Act 2004 except a workplace which is
        being used for the manufacture, construction, alteration, maintenance
        or repair of prescribed equipment for use outside a workplace; or

   (b)  prescribed equipment at a workplace except prescribed equipment which
        is being manufactured, constructed, altered, maintained or repaired
        for use outside a workplace; or

   (c)  prescribed equipment being used-

   (i)  in a mine within the meaning of section 369 of the Mines Act 1958; or

   (ii) in connection with work being done under a licence within the meaning
        of the Mineral Resources (Sustainable Development) Act 1990.
