Power to give directions
20A. Power to give directions
(1) An inspector may give a direction (either orally or in writing) to a
person at an equipment site if the inspector reasonably believes that it is
necessary to do so because of an immediate risk to the health or safety of any
person.
(2) A person must not, without reasonable excuse, refuse or fail to comply
with a direction given to the person under subsection (1).
Penalty: 500 penalty units for a natural person; 2500 penalty units for a body
corporate.
(3) An offence against subsection (2) is an indictable offence.
Note However, the offence may be heard and determined summarily (see section
53 of, and Schedule 4 to, the Magistrates' Court Act 1989).
