Changes to Project area and Extended Project area

7. Changes to Project area and Extended Project area



(1) The Governor in Council may, by Order published in the Government Gazette,
vary the Project area by doing either or both of the following-

   (a)  increasing the Project area by adding land in the vicinity of the
        Project area; or

   (b)  decreasing the Project area.

(2) The Governor in Council may, by Order published in the Government Gazette,
vary the Extended Project area by doing either or both of the following-

   (a)  increasing the Extended Project area by adding land in the vicinity of
        the Extended Project area; or

   (b)  decreasing the Extended Project area.

(3) An Order under this section takes effect on the day that it is published
in the Government Gazette or, if a later day is specified in the Order, on
that later day.

(4) An Order under this section must be made on the recommendation of the
Minister and the Minister administering the Planning and Environment Act 1987.





(5) The Ministers must not make a recommendation under subsection (4) unless
they have received the appropriate plans, which have been-

   (a)  signed by the Surveyor-General; and

   (b)  lodged at the Central Plan Office.

(5A) For the purposes of subsection (5), the appropriate plans may show the
Project area or Extended Project area as varied.

(6) The Minister must cause a copy of each Order under this section to be laid
before each House of the Parliament within 6 sitting days of that House after
the Order is made.

(7) Part 5 of the Subordinate Legislation Act 1994 applies to an Order under
this section as if that Order were a statutory rule within the meaning of that
Act.
