Compulsory acquisition of native title rights and interests

47. Compulsory acquisition of native title rights and interests



(1) The Authority may acquire a native title right or interest in land in the
Extended Project area by a compulsory process for the purposes of the Project
or any purpose connected with the Project.

(2) Subject to this Division, the Land Acquisition and Compensation Act 1986
applies to a compulsory acquisition referred to in subsection (1) and for that
purpose-

   (a)  the EastLink Project Act 2004 is the special Act; and



   (b)  the Southern and Eastern Integrated Transport Authority is the
        Authority.

(3) Section 3(3) of the Land Acquisition and Compensation Act 1986 does not
apply to the extent that this Division is inconsistent with that Act.
