Establishment of Authority

5. Establishment of Authority



(1) There is established by this Act an Authority by the name of the
Environment Protection Authority.

(2) The Authority-

   (a)  is a body corporate with perpetual succession;

   (b)  shall represent the Crown in right of the State of Victoria;

   (c)  shall have a common seal;

   (d)  may sue and be sued in its corporate name;

   (e)  shall, subject to this Act, be capable of taking, purchasing, leasing,
        holding, selling and disposing of real and personal property for the
        purpose of performing its functions and exercising its powers under
        this Act; and

   (f)  shall be capable of doing and suffering all such acts and things as
        bodies corporate may by law do and suffer and which are necessary or
        expedient for the purpose of performing its functions and exercising
        its powers under this Act.

(3) The common seal of the Authority shall be in such custody as the Authority
directs and shall not be used except as authorized by the Authority.
