Authority may authorise emergency storage, use etc. of waste
30A. Authority may authorise emergency storage, use etc. of waste
(1) Despite anything to the contrary in or under this Act, the Authority may
approve-
(a) the discharge, emission or deposit of waste from any premises into the
environment; or
(b) the storage, treatment, handling or disposal of waste on or from any
premises.
(1A) The Authority may only grant its approval under this section for the
purposes of-
(a) meeting a temporary emergency; or
(b) providing for the temporary relief of a public nuisance or community
hardship; or
(c) enabling the commissioning, repair, decommissioning or dismantling of
any item of industrial plant or fuel burning equipment.
(1B) An approval has no effect unless the conditions to which it is subject
are complied with.
(2) An application for an approval under this section-
(a) shall be made to the Authority in writing; and
(b) shall be dealt with by the Authority in a summary and expeditious
manner without regard to legal forms and solemnities.
(3) The Authority must grant its approval if it is satisfied that the activity
for which approval is sought will not cause a long term interference with any
beneficial use if the approval is granted.
(4) The Authority may grant its approval subject to such conditions as the
Authority considers appropriate.
(5) An approval under this section shall be subject to a condition that the
approved activity shall cease within 120 days of the day on which the approval
is given.
