Offences by bodies corporate

50. Offences by bodies corporate







(1) In this section, officer of a body corporate has the same meaning as in
section 82A of the Corporations Act except that it does not include an
employee of the body corporate.

(2) If a body corporate is guilty of an offence against this Act or a
regulation, any officer of the body corporate who was in any way, by act or
omission, knowingly concerned in or party to the commission of the offence is
also guilty of that offence and liable to the penalty for that offence.

(3) If in a proceeding for an offence against this Act or a regulation it is
necessary to establish the intention of a body corporate, it is sufficient to
show that a servant or agent of the body corporate had that intention.

(4) A statement made by an officer of a body corporate is admissible as
evidence against the body corporate in any proceeding against the body
corporate for an offence against this Act or a regulation.
