Compensation for mining exploration or work

27. Compensation for mining exploration or work



(1) A person who is the holder of a current work authority who is not the
owner of the land to which the authority applies is deemed to be an occupier
of the land for the purposes of section 85 of the
Mineral Resources (Sustainable Development) Act 1990.

(2) The holder of a work authority referred to in subsection (1) is only
entitled to compensation under section 85 of the
Mineral Resources (Sustainable Development) Act 1990 for the deprivation of
possession of the whole or any part of the surface of the land and for the
loss of opportunity to extract stone from the whole or any part of the land.
