Variation of work plan

18. Variation of work plan



(1) The Department Head may, by instrument served on the holder of a work
authority, approve the variation of, the work plan relating to that authority.

(2) The Department Head may direct the holder of a work authority to submit an
application for approval of-

   (a)  a variation of a work plan;

   (b)  a variation or revocation of any condition imposed on the approval of
        a work plan;

   (c)  the imposition of new conditions on the approval of a work plan.

(3) The holder of a work authority who proposes to vary an approved work plan
or is directed by the Department Head under subsection (2) to submit an
application must lodge an application for approval of the proposed variation
with the Department Head.

(4) An application for approval of a variation must contain the prescribed
information.

(5) The Department Head must, within 1 month after the application for
approval of a variation is lodged-

   (a)  approve the variation with or without conditions; or

   (b)  require the changes specified in a notice to the holder of the work
        authority to be made before the variation will be approved; or

   (c)  refuse to approve the variation-

and notify the holder of the work authority.

(6) The Department Head must not approve a variation of a work plan unless-



   (a)  he or she has consulted the municipal council in whose municipal
        district the land is situated;

(7) Once the Department Head has decided to approve a variation the approved
work plan for the work authority is the work plan as amended by that
variation.
