Community services

47. Community services



(1) An agreement by a retailer with the State for the provision of community
services is an agreement for a term of not less than 5 years for the provision
by the retailer of electricity to a class of domestic customers specified by
the Secretary to the Department of Human Services-

   (a)  at such concessional rates and in such manner and at such times as are
        determined by the Secretary; and

   (b)  on such other terms and conditions as are agreed between the retailer
        and the State or, in default of agreement, as are determined by the
        Secretary.

(2) In determining terms and conditions under subsection (1)(b), the Secretary
must have regard to the risks and costs associated with the obligations
imposed on the retailer under the agreement and must ensure that the terms and
conditions are consistent with any relevant concession order made under the
State Concessions Act 2004.
