ELECTRICITY INDUSTRY ACT 2000 - SECT 37

Deemed contracts with former franchise customers

    (1)     If a person—

        (a)     was a franchise customer within the meaning of the Electricity Industry Act 1993 immediately before 1 January 2001; and

        (b)     has not entered into a new contract with a licensee which takes effect on or after that date—

there is deemed to be a contract between that person and the licensee of which the person was a customer immediately before that date for the supply and sale of electricity at the tariffs and on the terms and conditions determined and published by that licensee under section 35.

    (2)     The deemed contract continues until—

        (a)     the contract is terminated; or

        (b)     if the customer enters into a new contract for the purchase of electricity from the licensee in respect of the same premises, on the date of taking effect of that new contract—

whichever occurs first.
