Exceptions from prohibition

33. Exceptions from prohibition

A prohibition in section 24 or 32 does not apply if-

   (a)  the prohibition arises as a result of an acquisition referred to in
        section 88(9)(a) or (b) of the Trade Practices Act 1974 of the
        Commonwealth; and

   (b)  either-

   (i)  the acquisition was authorised under the Trade Practices Act 1974 of
        the Commonwealth; or

   (ii) the Commission has decided that it is satisfied that the ACCC has
        considered the acquisition and that the ACCC has notified the person
        that it does not intend to take action in relation to the acquisition
        under section 50 of that Act.
