Application for estate agent's licence

17. Application for estate agent's licence



(1) A person may apply to the Authority for an estate agent's licence.





(1A) The application must be made in the form specified by the Authority and
must be accompanied by the prescribed fee.

(2) An application by a person other than a corporation must-

   (a)  state-

   (i)  the address of the place or places at which the applicant intends to
        carry on business;

   (ii) the address which he desires to be recorded as a registered office for
        the purposes of this Act;

   (iii) where the applicant intends to carry on business at more than one
        place, the address which he desires to be recorded as his principal
        office for the purposes of this Act; and

   (iv) in the case of an application by a member of a partnership, the names
        and addresses of all the partners;

   (c)  be accompanied by-

   (i)  the name, occupation and contact details of 3 character references (at
        least one of whom is a former or current employer of the applicant);
        and

   (ii) if the applicant has applied to be granted a licence in accordance
        with section 14(1)(a), full particulars of the applicant's employment
        as an agent's representative during the relevant period; and

   (iii) a statement by the applicant certifying that the particulars
        contained in the application are true and correct.

(4) An application by a corporation must-

   (a)  state-

   (i)  the address of the place or places at which the corporation intends to
        carry on business; and

   (ii) its registered office under the Corporations Act; and

   (iii) the address which is to be recorded as its registered office for the
        purposes of this Act; and

   (iv) if the corporation intends to carry on business at more than one
        place, the address which it desires to be recorded as its principal
        office for the purposes of this Act; and

   (b)  contain any other details that are required by the Authority; and

   (c)  unless the applicant is a declared corporation, be accompanied by the
        documents referred to in section 19; and

   (d)  if the applicant is a declared corporation, state the name and address
        of the officer in effective control of the estate agency business of
        the corporation.
