39. Additional penalties for offences involving explosives



(1) Where a person is guilty of an offence against this Act in respect of the
import into Victoria of any explosives, all or any part of the explosives may
be forfeited to the Government of Victoria.

(2) Notwithstanding the provisions of section 45 and of any provision of this
Act which prescribes a specific penalty for an offence, a person who is guilty
of an offence under this Act in relation to any explosives is liable, in
addition to or in lieu of any other penalty to which the person is liable
under this Act, to a penalty not exceeding 1 penalty unit for every kilogram
or part of a kilogram of the explosives and the penalty imposed under this
section shall be no less than 5 penalty units.
