38. Exemption of licensee where consignee etc. at fault

Where the holder of a licence to transport explosives contravenes this Act by
reason of the wilful act, neglect or default of the consignor or consignee of
the explosive or other person, or by the improper refusal of the consignee or
other person to accept delivery of the explosive, the conviction of the
consignor, consignee or other person shall exempt the licensee from any
penalty under this Act in respect of any breach of this Act arising from the
wilful act, neglect, default or improper refusal to accept delivery.
