Effect of a variation on the contract price

39. Effect of a variation on the contract price

Unless the contrary intention appears, if the plans or specifications set out
in a major domestic building contract are varied in accordance with section 37
or 38, any reference in this Act, the regulations or the contract to-

   (a)  those plans or specifications is to be read as a reference to them as
        varied; and

   (b)  the contract price is to be read as a reference to the contract price
        as adjusted to take account of the variation; and

   (c)  the completion date, or the number of days required to finish the
        work, is to be read as a reference to that date, or number of days, as
        adjusted to take account of the variation.
