Notice before refusal or revocation
44. Notice before refusal or revocation
(1) The Secretary must not refuse an application under section 40 unless the
Secretary has given a notice in writing to the person making the application
in accordance with subsection (3) and has considered any submission made by
the person.
(2) The Secretary must not refuse an application under section 42 or revoke
the registration of a disability service provider under section 43(1) unless
the Secretary has given a notice in writing to the disability service provider
in accordance with subsection (3) and has considered any submission made by
the disability service provider.
(3) The notice must specify-
(a) the proposed decision and the reasons for the proposed decision;
(b) that the person or the disability service provider may make a
submission in writing within 14 days of the notice being given.
