The Senior Practitioner

23. The Senior Practitioner



(1) Subject to the Public Administration Act 2004, there is to be appointed by
the Secretary as the Senior Practitioner a person who in the opinion of the
Secretary has the appropriate clinical qualifications and experience to
perform the functions and exercise the powers conferred on the Senior
Practitioner by or under this Act.

(2) Subject to the general direction and control of the Secretary, the Senior
Practitioner-

   (a)  is generally responsible for ensuring that the rights of persons who
        are subject to restrictive interventions and compulsory treatment are
        protected and that appropriate standards in relation to restrictive
        interventions and compulsory treatment are complied with;

   (b)  has the powers, duties, functions and immunities that are conferred or
        imposed on the Senior Practitioner by or under this or any other Act.
