Powers of authorised investigator
90. Powers of authorised investigator
(1) The authorised investigator may at any time visit the out of home care
service that approved, employed or engaged the person who is the subject of
the investigation-
(a) to inspect any document or record relating to a person who is the
subject of the investigation or the child in relation to whom the
allegation was made; and
(b) to interview any person employed or engaged by the out of home care
service whom the authorised investigator considers to be relevant to
the investigation.
(2) The authorised investigator may interview-
(a) the child in relation to whom the allegation was made; and
(b) the person who is the subject of the investigation.
(3) Before interviewing a child, the authorised investigator must consider,
and take all reasonable steps to mitigate, any negative effect that the
interview may have on the child.
(4) The person who is the subject of the investigation may, but is not
required to, answer any question of, or provide any information to, the
authorised investigator.
