CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 6

    (1)     The Governor in Council may, by Order published in the Government Gazette, declare an organisation to be an Aboriginal agency.

    (2)     An organisation may only be declared to be an Aboriginal agency if—

        (a)     it is a registered community service; and

        (b)     the Secretary is satisfied—

              (i)     that it is managed by Aboriginal persons; and

              (ii)     that its activities are carried on for the benefit of Aboriginal persons.

    (3)     An Order in Council made under subsection (1) with respect to an organisation must state that the Secretary is satisfied as to the matters referred to in subsection (2).
