CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 135

Short-term child care agreements

    (1)     A parent of a child may enter into a written agreement with a service provider to place the child in the care of the service provider for the purpose of supporting the child and his or her parent and encouraging and assisting the child's parent to resume the care of the child.

    (2)     An agreement under subsection (1) does not affect the guardianship and custody of a child.

    (3)     An agreement under subsection (1) must specify a period not exceeding 6 months, for which the agreement is to have effect.

    (4)     The wishes of the child must be taken into account in making an agreement under this Division.

    (5)     A service provider (other than the Secretary) must notify the Secretary in writing of each agreement entered into by the service provider under subsection (1) within 14 days after entering into the agreement.
