Child Wellbeing and Safety Act 2005 - SECT 46

Offence to fail to give notice

46. Offence to fail to give notice



(1) Any person who fails to give notice of a birth in accordance with this
Part is guilty of an offence and is liable to a penalty of not more than 1
penalty unit.

(2) It is a defence to a prosecution for an offence under subsection (1) if
the person-

   (a)  satisfies the court that he or she had reasonable grounds to believe
        that notice had been duly given by another person; or

   (b)  had other reasonable grounds for not giving the notice.
