Judge constituting court
12. Judge constituting court
(1) The judge constituting the court when the trial of an accused takes place
before a jury need not be the judge who constituted the court at a directions
hearing held in connection with the trial.
(2) Any ruling made by a judge at a directions hearing who is not the trial
judge is binding on the trial judge unless, in the opinion of the trial judge,
it would not be in the interests of justice for the ruling to be binding.
