When general transfer may take place
6. When general transfer may take place
(1) A general transfer of proceedings from one court to another may take place
if the senior judicial officers of those courts agree that one court is
overloaded with pending proceedings relative to the other court and that there
should be a transfer of an agreed number of proceedings.
(2) An agreement under subsection (1) is of no effect unless it has the
approval of the Council of Judges or magistrates (as the case requires) of
both courts.
(3) An approval under subsection (2) may be given before or after the making
of the agreement.
