8. Offence to advertise unlicensed etc. children's service



(1) A person must not publish or cause to be published an advertisement for a
children's service unless the children's service is licensed to operate under
this Act or an approval of premises has been granted for the children's
service under this Act.

Penalty: 120 penalty units.

(2) It is a defence to a charge under subsection (1) if the defendant proves
that he or she took reasonable steps or exercised due diligence to determine
that the children's service was licensed to operate under this Act or an
approval of premises had been granted for the children's service under this
Act.
