Notice to take emergency action

43A. Notice to take emergency action



(1) If the Secretary is satisfied that a children's service is operating in a
manner that poses, or is likely to pose, a risk to the health, welfare or
safety of a child being cared for or educated by the service, the Secretary
may, by written notice, direct the proprietor of the children's service to
take the steps specified in the notice to remove or reduce the risk within the
time specified in the notice.

(2) A proprietor of a children's service must comply with a direction given
under subsection (1).

Penalty: 120 penalty units.
