Offence

17. Offence



(1) A person must not make an application under section 16 for the
registration of a security interest if that person is not the holder of the
interest.

Penalty: 5 penalty units.

(2) It is a defence to a prosecution of a person for an offence under
subsection (1) if the person proves that when the application was made the
person believed on reasonable grounds that the person was the holder of the
security interest.
