74D. Parent failing to send child to school
(1) Every person who being the parent of a child fails to cause such child to
attend a State school as required by this Division shall unless there is a
reasonable excuse for such failure be liable for a first offence to a penalty
of not more than $20 and in default of payment may be imprisoned for a term of
not more than seven days, and for a second or any subsequent offence in
respect of the same or any other child to a penalty of not less than $20 nor
more than $40 and in default of payment to imprisonment for a term of not more
than fourteen days.
(2) In any proceeding under this section-
(a) the court may, with the consent of the parent, be held within closed
doors; or
(b) the Court may be held at any State school; and
(c) in either event the Court may hear and determine the matter without
requiring the presence at the court or the school of the parents or
the child in respect of whom the proceeding is taken.
