Inspection of exhibits that include child abuse material where accused is legally represented

    (1)     This section applies if—

S. 43A(1)(a) amended by No. 47/2016 s. 37(3).

        (a)     a request under section 43(1)(c) relates to an exhibit, or a part of an exhibit, that is child abuse material; and

        (b)     the accused is legally represented.

    (2)     The accused may request inspection of the exhibit, or the part of the exhibit, by the accused's legal practitioner (but not the accused personally).

Example

The informant may agree with the accused's legal practitioner on a time and place for the accused's legal practitioner to inspect exhibits that include child abuse material. The legal practitioner may not show such an exhibit to the accused but may discuss its content with the accused in order to obtain instructions.
