5. Application of certain provisions of the Local Government Act 1989



(1) The following provisions of the Local Government Act 1989 do not apply to
the Council or the City of Melbourne: sections 5B, 40(1), 71, 72, 73, 74, 74A,
74B and 220Q(i), (j), (k), (l), (m), (n), (na) and (nb).

(2) Schedules 2, 3 and 3A of the Local Government Act 1989 only apply to the
Council and the City of Melbourne as specified in this Act.

(3) Division 1 of Part 3 of the Local Government Act 1989 does not apply to
the Council or the City of Melbourne.

(4) Sections 21, 22, 23, 23A, 24, 24A, 24B and 24C of the
Local Government Act 1989 do not apply to the Council and the City of
Melbourne.

(5) Divisions 2 and 3 of Part 10 of the Local Government Act 1989 do not apply
to the Council and the City of Melbourne.
