Court may resolve difficulties
44. Court may resolve difficulties
(1) Where any difficulty arises in the application to a particular matter of
this Part, or in the application to a particular matter of any of the
provisions of the Companies (Victoria) Code, the Companies Act 1961 or the
Marketable Securities Act 1970 by reason of the operation of this Part, the
Court may, on the application of an interested person, make such order as it
thinks proper to resolve the difficulty.
(2) An order made under subsection (1) has effect notwithstanding anything
contained in this Act or in the Companies (Victoria) Code, the Companies Act
1961 or the Marketable Securities Act 1970.
(3) In subsection (1), Court means the Supreme Court.
