When can an authority be varied?

20. When can an authority be varied?



(1) The chief officer may vary an authority-

   (a)  at any time on the chief officer's own initiative; or

   (b)  on application under section 21.

(2) However, an authority cannot be varied so as to extend its period of
validity if the authority is-

   (a)  an authority for a local minor controlled operation (whether formal or
        urgent); or

   (b)  an urgent authority for a cross-border controlled operation or local
        major controlled operation.

(3) Also, an authority cannot be varied unless the chief officer is satisfied
on reasonable grounds that the variation will not authorise a significant
alteration of the nature of the authorised operation concerned.
