20. Consent required for procuring of forest produce or carrying out fire
prevention works on reserved land
(1) Notwithstanding anything in the Forests Act 1958 the Secretary shall not
use or permit or authorize any person or body to use any land reserved under
section 4 for the procuring or the production of any forest produce (within
the meaning of the Forests Act 1958) without the prior consent of the person
or body having control and management of the land.
(2) Notwithstanding anything in the Forests Act 1958 the Secretary shall not
carry out any works of fire prevention on any land reserved under section 4
unless such land is protected public land within the meaning of that Act
without having first consulted the person or body having control and
management of the land and having obtained the agreement of that person or
body to the works proposed.
(3) Where the Secretary and the person or body having control and management
of any land reserved under section 4 cannot agree as to any works of fire
prevention which the Secretary considers should be carried out the matter
shall be referred to the Governor in Council whose decision shall be final.
