Leases may contain options for renewal and overholding clauses
17F. Leases may contain options for renewal and overholding clauses
(1) Without limiting any other provision of this Act, a lease or a tenancy
agreement under this Act may contain-
(a) options for the lessee or tenant to renew the lease or tenancy
agreement for a further term or terms; and
(b) provision for a lessee or tenant to remain in occupation of the land
under the same terms and conditions as existed under the lease or
tenancy agreement, at the discretion of the lessor, for a period not
exceeding 3 months from the expiry of the lease or tenancy agreement.
(2) If a lease or tenancy agreement contains options for renewal by the lessee
or tenant, the aggregate of the original term and the further term or terms
must not exceed the maximum term for which, apart from this section, the lease
or tenancy agreement may be granted.
