16. General provisions as to proceedings for offences

The following provisions have effect with respect to proceedings for offences
against this Act-

   (a)  the onus of proof that the person named in a charge as an employee of
        the defendant was not employed as alleged in that charge is on the
        defendant;

   (b)  it is not a defence that an employer was not in Victoria at the time
        the alleged offence was committed.
