Commencement of prosecution for an offence

79. Commencement of prosecution for an offence



(1) A prosecution for an offence against this Act in relation to a film,
publication or computer game that is unclassified at the time of the alleged
offence-

   (a)  must not be commenced until the film, publication or computer game has
        been classified; and

   (b)  unless the contrary intention appears, may be commenced not later than
        12 months after the date on which the film, publication or computer
        game was classified.

(2) Subsection (1)(a) does not apply if a person has been apprehended in
accordance with section 458 of the Crimes Act 1958.
